Supplemental Privacy Notice for Children (COPPA)

This Supplemental Privacy Notice for Children (“Children’s Privacy Notice”) governs CrunchLabs’s collection, use and disclosure of personal information from children under the age of thirteen in the United States (each a “Child” and collectively “Children”). This Children’s Privacy Notice supplements CrunchLabs’s Privacy Notice to notify parents and/or guardians (each a “Parent”) of:

  • The types of personal information CrunchLabs may collect from Children;
  • How CrunchLabs uses the personal information it collects from Children;
  • CrunchLabs’s practices for disclosing that Child’s personal information; and
  • How a Parent may request access, modification, and deletion of the Children’s personal information CrunchLabs has collected.

An Important Note: This Children’s Privacy Notice does not apply to the practices of any third-party services (including apps, skills, and websites) that may be accessed through the Services, such as YouTube. Before using any third-party service, you should review the applicable terms and policies to determine their appropriateness for your child, including the service’s data collection and use practices.

If any provisions in this Children’s Privacy Notice conflict with the Privacy Notice, this Children’s Privacy Notice controls. 

Personal Information We Collect from Children

We collect personal information from a Child in connection with the creation or administration of the Parent’s account or when the Child uses the Services in connection with their Parent’s account. 

Personal information we collect in connection with the creation or administration of a Child’s account may include the Child’s first name, email address, demographic information about the Child such as year born and gender (as provided by the Child or Parent). 

Personal information that CrunchLabs collects in connection with the Child’s use of the Services may include messages or chats with other users and photos and videos, in each case only when enabled by the Child and/or Parent. 

In addition, if a Child communicates with us for support or other purposes, we may collect personal information that the Child provides us.  For example, if a Child asks for help with their code through or automated chat feature, or posts questions or other information on our community forum, we and our service providers collect, store, and process the information they provide to us.  

We may collect certain personal information from Children automatically when they use our Services, such as Internet protocol (IP) address, user settings, cookie identifiers, mobile advertising and other unique identifiers, browser or device information, and Internet service provider. We may also automatically collect personal information regarding a Child’s use of our Services, such as analytics about a Child’s use of the Services, personal information contained in any content a Child generates using our Services, details about the Child’s projects, pages that a Child visits before, during and after using our Services, information about the links a Child clicks, the types of content a Child interacts with, the frequency and duration of a Child’s activities, and other information about how a Child uses our Services.

How We Use Children’s Personal Information 

We use personal information collected from Children to provide the Services or to provide support for the internal operations of the Services. 

How and When We May Disclose Children’s Personal Information

We may disclose a Child’s personal information:

  • To other users of the Services that a Child shares or interacts with. 
  • To service providers we use to provide the Services or to provide support for the internal operations of the Services.
  • If we are required to do so by law or legal process, such as to comply with any court order or subpoena or to respond to a valid government or regulatory request.
  • If we believe the disclosure is necessary or appropriate to protect the rights, property, or safety of CrunchLabs, our customers or others, including to:
    • protect the safety of a Child;
    • protect the safety and security of the Services; or
    • enable us to take precautions against liability.

In addition, if we are involved in a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of CrunchLabs’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding or event, we may transfer the Children’s personal information it has collected or maintain to the buyer or other successor.

Retention of Children’s Personal Information

We will retain the information collected from a Child only for the amount of time necessary to fulfill the purpose for which it was collected.

Parental Choices and Controls

At any time, a Parent may use the Services to review a Child's personal information, require us to correct or delete a Child’s personal information, and/or refuse to permit us from further collecting or using a Child’s personal information. Please keep in mind that a request to delete records may lead to a termination of an account and/or the Services.

A Parent can request assistance from us to change or delete Children’s personal information by sending us an email at help@CrunchLabs.com. We may require that the Parent take certain steps or provide additional information to verify their identity before CrunchLabs provides any information or makes corrections.
